Our spaces are perfect for businesses hosting training sessions, classes, or seminars. You’ll have access to both our coworking space and/or the children’s room. Both Erina and St Leonards have access to TV screens with HDMI cables. 

These terms and conditions (Terms) govern the hire of Space in the Premises operated by Bubbadesk and by booking and using the Space, the hirer (Hirer) agrees to comply with these Terms.

 

1.          Definitions

 

BubbaDesk means BubbaDesk Pty Ltd.

 

Hirer means the person/entity hiring the Space/Premises and includes Hirer’s servants, agents, contractors, subtenants and/or invitees.

 

Hirer’s Property means any equipment, documents, property or possessions that the Hirer brings into the Space or Premises.

 

Our Property means any furniture, equipment, documents or other property in the Space/ Premises that is owned or controlled by Bubbadesk.

 

Premises/ Space mean any buildings and facilities where BubbaDesk’s coworking space is located, including the creche where Nanny Services are provided by BubbaDesk and including but not limited to the following:

 

o   Suite 5 & 6 203 The Entrance Road, Erina, NSW, 2250.

 

o   92 Chandos Street, Naremburn, NSW, 2065.

 

o   25 Wurrook Circuit, Caringbah, NSW, 2229.

 

o   Enterprise 1, Innovation Campus, Suite 6 & 8, Squires Way, North Wollongong NSW 2500.

 

o   Ground Floor, Suite 2/18 Flour Mill Way, Summer Hill NSW 2130.

 

 

 

2.          Booking and Payment

 

2.1       Booking of Space can be made by sending an email to [email protected]

 

2.2       Full payment is required at the time of booking by electronic funds transfer (EFT), credit card, or other electronic payment methods as provided by BubbaDesk. The Hirer shall ensure that all electronic payments are made to BubbaDesk’s designated bank account or payment gateway as specified in writing by BubbaDesk.

 

2.3       All bookings for a Space are tentative until the Hirer has paid for the booking in full.

 

2.4       Depending on the nature of the booking, BubbaDesk may require a Bond to be paid to BubbaDesk. The Bond is security for your performance of all of Hirer’s obligations under the Terms.

 

2.5       The Hirer must provide accurate contact details, and any other information required at the time of booking.

 

2.6       Any Space booking that is cancelled or reduced in writing up to 72 hours before the start time will not be charged for the cancellation or reduction.

 

2.7       Any Space booking that is cancelled or reduced in writing less than 72 hours before the start time is liable for 100% of the cost of the booking and will not be refunded for the cancellation or reduction.

 

2.8       Any booked catering services (excluding tea & coffee provided by BubbaDesk) hired AV services or any other services for any meeting room or Space booking that are cancelled less than 72 hours before the start time shall be liable for 100% of cost of that service.

 

2.9       If, for any reason, the Space booked is no longer available at the time requested, notice shall be given to the Hirer as soon as possible and, subject to availability, a meeting room of similar or higher standard offered in place for the same rate.

 

3.          Hire Period

 

3.1       The Space is available for hire on weekends from 8am to 6pm.

 

3.2       The Hirer must adhere to the agreed hire period. Any extension of the hire period must be approved by BubbaDesk in advance and may incur additional charges.

 

4.          Use of Space

 

4.1       The Space is to be used solely as commercial office and for the purpose of meetings and related activities.

 

4.2       The Hirer must not use the Space for any unlawful or inappropriate activities.

 

4.3       The Hirer is responsible for ensuring that the Space is used in a manner that does not cause damage to the Premises or disturb other occupants.

 

4.4       The Hirer must return the Space in the same condition as it was at the time of the handover. Any damage to the fixtures and fittings, walls, doors or AV system will be charged back to the Hirer.

 

4.5       The Hirer must ensure that Hirer’s Property is used in a safe manner and any electrical equipment that the Hirer brings into the Space is inspected and tested. 

 

4.6       The Hirer acknowledges that the Hirer will be liable for and agree to indemnify Bubbadesk for any damage caused to the Space or Our Property, or for any claim brought against us, by malfunctioning or incorrectly used equipment brought into the Space by the Hirer. This includes, but is not limited to, damage caused by non-compliant electrical equipment or electrical equipment not fit for use in Australia.

 

4.7       The Hirer is responsible for making good or indemnifying BubbaDesk (and hereby authorises BubbaDesk to charge the Hirer) for any damage caused to the Space or Our Property by the Hirer, its employees or guests (excluding fair wear and tear).

 

5.          Cleaning

 

The Hirer must leave all hired areas of the Space, in a clean and tidy condition, removing all personal property, all decorations of any kind, disposing of refuse in the rubbish bins provided, wiping down all benches and sinks, and sweeping floors if required to return the Space to a clean condition. If the Hirer does not comply with this clause, the Hirer will accept responsibility for, and pay the cost of, any additional cleaning of the Space.

 

6.          Noise Controls

 

Music sound levels must not cause annoyance to other occupants of the Space or building or centre of which the Space forms part.

 

7.          Keys/Swipe Cards

 

7.1       Prior to the date of the booking the Hirer may be provided swipe card/keys to access the Premises for the event upon supply proof of booking is shown.

 

7.2       The Hirer shall use the keys/swipe cards to only open areas of the Premises that the Hirer has booked.

 

7.3       If the swipe card/keys are lost or not returned to BubbaDesk, the Hirer will be required to pay all necessary costs and expenses incurred by BubbaDesk for replacing such swipe cards/keys.  

 

8.          Compliance

 

8.1       The Hirer must comply with all relevant employment contracts and awards, if applicable, when engaging any staff for the event while using the Space.

 

8.2       The Hirer must ensure that all staff working during the hire period are provided with appropriate breaks and rest periods in accordance with the National Employment Standards (NES).

 

8.3       The Hirer must obtain and comply with all necessary and required approvals and permits from the regulatory authority for conducting the event in the Space in accordance with the Terms.

 

9.          Local Regulations

 

9.1       The Hirer must comply with all local council regulations and any other applicable laws and regulations.

 

9.2       The Hirer must ensure that noise levels are kept to a minimum to avoid disturbing other occupants and neighbouring properties.

 

10.       Health and Safety

 

10.1    The Hirer must ensure that the Space is used in a safe manner and that all health and safety regulations are adhered to.

 

10.2    The Hirer must report any accidents, injuries, or hazards to BubbaDesk immediately.

 

10.3    The Hirer or any person using the Space or Premises are not permitted to use within the premises any type of gas bottle or gas cookers.

10.3

11.       Insurance

 

11.1    The Hirer is responsible for obtaining any necessary insurance coverage for their event, including public liability insurance.

 

11.2    BubbaDesk is not liable for any loss, damage, or injury sustained by the Hirer or their guests during the hire period and/or in relation to the access to the Space and BubbaDesk’s insurance does not provide coverage for, any loss incurred by a member, except when caused by the BubbaDesk’s negligence.

 

12.       Advertising

 

12.1    The Hirer must not place advertisements of any description or kind on any section or part of the Premises.

 

12.2    If the Hirer advertises the event, it must obtain the prior written consent from BubbaDesk.

 

13.       Indemnity

 

13.1    To the maximum extent permitted by law:

 

(i)             the Hirer agrees to indemnify and hold BubbaDesk harmless from any claims, losses, damages, liabilities, and expenses arising out of or in connection with the Hirer’s access and use of Space and breach of these Terms by the Hirer.

 

(ii)            BubbaDesk, its related bodies corporate, their officers, employees, contractors and agents shall not be liable for any theft, loss or damage from the Premises howsoever occurring or for any damage done to the furniture or other effects of the Hirer by a caretaker, cleaners or any employees, contractors, agents or invitees of BubbaDesk;

 

(iii)           BubbaDesk shall not be liable for any loss, damage or loss of information resulting from communications or data failure including voice, communication and the internet; and

(iv)           BubbaDesk shall not be liable for any loss, damage, corruption of data or any loss of information whether from hardware, software or internet damage that may occur.

 

13.2    BubbaDesk’s liability to the Hirer for breach of these Terms will be capped at an amount equal to booking fee paid by the Hirer for the use of the Premises. BubbaDesk will not be liable for any indirect or consequential loss, including any loss of actual or anticipated business, income or loss of opportunity.

 

14.       Termination

 

14.1    BubbaDesk reserves the right to terminate the Terms immediately if the Hirer breaches any of these Terms.

 

14.2    Upon termination, the Hirer must vacate the Space immediately and ensure that they are left in a clean and tidy condition in accordance with the Terms.

 

15.       Governing Law

 

15.1    These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.

 

16.       Amendments

 

16.1    BubbaDesk reserves the right to amend these Terms at any time.

 

17.       Entire Agreement

 

17.1    These Terms constitute the entire agreement between BubbaDesk and the Hirer and supersede all prior agreements, understandings, and negotiations.
